User Agreement
1. General provisions
1.1. This User Agreement governs access to chimate.ai (the Service), its browser assistant and its Windows application. Administration means the owner and those operating the Service. User means a person using the Service's features. Contact email: support@chimate.ai.
1.2. The Service is intended for people aged 16 and over. Paid orders require sufficient legal capacity for the transaction and, where required by applicable law, permission from a legal representative.
1.3. Before using the Service or placing an order, the User reviews this Agreement, the Privacy Policy and the selected offer. Using the Service's features signifies acceptance of this Agreement. The document can be saved using browser tools. Any consent that must be obtained separately under applicable law is provided separately.
1.4. Users who disagree with these terms must stop using the Service and refrain from placing new orders. Rights relating to previously paid orders remain in effect; requests concerning them are handled under section 7.
2. Service description and access
2.1. chimate.ai provides software features for AI-powered image analysis, including text recognition, question analysis, explanations, translation and code analysis. The Service processes images submitted by the User and displays a result. Access is available through a supported browser or the Windows application; current requirements and available features are listed on the website.
2.2. Images are captured and sent in response to User actions or through automatic modes enabled by the User. The User chooses the materials submitted and the assistant's settings. An account allows the User to save settings and access available request history.
2.3. Payment covers access to Service features and processing capacity measured in credits. A credit is an internal unit for tracking feature usage, not money or a payment instrument. Subscriptions provide credits for a limited period; separate packs provide non-expiring credits for later use.
2.4. One analysis request costs 1 credit for Simple, 2 credits for Advanced and 3 credits for Top. The price applies to an analysis request, including one containing multiple questions. Available model tiers depend on the plan; pack credits allow any tier to be used. Changes to the cost of future requests are communicated before taking effect.
2.5. Prices, currency, credit quantities, access duration, available tiers and current promotions are listed on the Pricing page and specified when an order is placed. Promotional allocations apply within the stated promotion period. The terms of a particular paid order are not made less favourable retroactively.
2.6. If an offer is expressly described as unlimited, this applies only to its stated features under ordinary personal use. It does not mean unlimited processing speed, concurrent requests or sessions, access to every model or permission for bulk automated processing. Credit-plan and pack limits continue to apply unless the offer expressly states otherwise.
2.7. To protect availability, the Service may use queues and limits on request frequency and concurrency. Where abuse is suspected, the relevant feature may be temporarily slowed or suspended for review. Quantitative limits and fair-use rules affecting ordinary use of a paid offer must be disclosed before payment; new permanent limits are not imposed retroactively on an already paid period. Measures must be proportionate to the load or violation. Users may contact support about the reasons and restoration of access.
3. AI results and liability
3.1. AI results may contain errors, inaccuracies or incomplete information. The User independently verifies answers for their intended purpose and decides what action to take. AI answers are provided as assistance.
3.2. The Service does not promise a particular outcome in an examination, interview, employment decision or other external event. This does not remove the obligation to provide paid access and the agreed volume of services.
3.3. Availability of individual features depends on the User's browser, operating system, equipment, connection and third-party AI providers. Technical interruptions and changes to available models are possible. The Administration communicates material limitations and reviews reports of malfunctions. If paid services are not delivered, the User may request restoration of access and a refund where applicable.
3.4. The parties' liability is governed by this Agreement and applicable law. Nothing in this document excludes liability that cannot legally be limited by contract or removes mandatory consumer rights.
3.5. Compatibility of keyboard shortcuts, screen capture and window hiding depends on operating-system settings and restrictions and on third-party software. The User checks the required mode in their environment before use. The Service does not guarantee that the assistant will remain invisible in every application, recording system or monitoring tool.
4. Accounts and acceptable use
4.1. The User provides accurate information, uses an accessible email address, keeps their account secure and does not share access credentials with unauthorised persons. Compromised accounts, vulnerabilities and abuse should be reported to support.
4.2. The User only submits materials they have a lawful basis to process. Before sending a screenshot, the User must check its contents and remove unnecessary personal data, passwords, payment details and other people's confidential information.
4.3. The Service must not be used for unlawful activities, fraud, unauthorised access to information, infringement of third-party rights, circumvention of free-access restrictions or interference with infrastructure. Bypassing technical limits, generating excessive automated load or attempting to access other users' accounts or data is prohibited.
4.4. The User complies with applicable rules of the platforms and organisations where the assistant is used, including requirements for independent work and confidentiality. Technical capability does not grant permission to violate those rules.
4.5. Automated access is permitted through built-in features and interfaces authorised by the Administration, within their published terms. Bulk scraping, systematic request probing and load testing without approval, bypassing API limits by rotating accounts, IP addresses, devices or tokens, and exploiting accounting errors to obtain unpaid access are prohibited.
4.6. Extracting or using other people's API keys, tokens or other secrets, interfering with protective mechanisms, modifying a client to bypass checks, or copying or examining software in ways that infringe rights is prohibited. This restriction does not cover actions expressly permitted by applicable law.
4.7. Without separate permission from the Administration, Users must not resell access, share an account with an unrestricted group, use the Service as a proxy for third-party AI or embed access in a paid product for others. Personal use of answers does not itself constitute resale of access.
5. Intellectual property
5.1. Rights to chimate.ai's software, design and original materials belong to their respective rights holders. The User is permitted to use the Service's features within the selected offer. Rights to third-party materials and software components remain with their respective rights holders.
5.2. The User retains rights to their materials and permits their storage, transmission and processing to the extent needed to fulfil requests and provide Service features, including transmission to AI providers under the Privacy Policy. The Administration does not acquire exclusive rights to submitted screenshots, prompts or works contained in them.
5.3. Selected questions may be used to improve the Service or published only under the conditions of the Privacy Policy, including removal of personal and confidential information and account links. This Agreement does not grant general permission to publish original screenshots.
5.4. Use of AI results must respect third-party rights. The Administration does not guarantee that results are exclusive or claim ownership of them.
6. Access restrictions and termination
6.1. The Administration may restrict access for a confirmed breach of this Agreement, a security threat, abuse of technical resources or a binding request from a competent authority. Restrictions must be proportionate to the reason and extent of the violation.
6.2. The User is informed of the reason for a restriction unless notification is impossible or prohibited by law. Urgent measures may precede notification. Decisions may be challenged through support.
6.3. Account restrictions do not automatically forfeit all payments. Paid but undelivered services are reviewed in light of the circumstances and mandatory legal requirements.
6.4. The User may stop using the Service and delete their account in Profile or contact support. Any auto-renewal should be disabled before deleting an account. Account deletion does not itself replace cancellation of a subscription with the payment provider; contact support if assistance is needed. Data retention and deletion periods are set out in the Privacy Policy.
7. Payments, subscriptions and refunds
7.1. The price and contents of a purchase depend on the selected offer. Before confirming payment, the User checks the product, total amount, currency, credit quantity, access duration and auto-renewal terms. Payments are handled by the provider identified at checkout, including Lava.top. Payment information is processed under that provider's rules.
7.2. Access or credits are granted after successful payment is confirmed. If a payment is debited but the purchase does not appear, contact support@chimate.ai with the account email, payment date, amount and identifier. Full card numbers, CVV/CVC and verification codes are not required.
7.3. A subscription remains valid for the paid period. Access duration is stated in the selected plan and its expiry date is shown in the account. For auto-renewing offers, the frequency and terms of subsequent charges are established at checkout. A calendar month is not automatically equal to 30 days; check the next billing date in the subscription terms with the payment provider.
7.4. Unused subscription credits do not roll over: renewal replaces the balance with the allocation for the new period. Purchasing a different plan activates a new period and balance in place of the previous one. Separate pack credits do not expire when a subscription ends or renews and can be used without an active subscription. Subscription credits are spent first when the selected tier is allowed by the plan; a request for a tier outside the plan is paid entirely with pack credits. Automatic capture requires an active paid subscription.
7.5. Automatic charges apply only to offers with stated auto-renewal and the necessary User consent. A one-time pack or non-renewing purchase does not authorise recurring charges. Auto-renewal can be disabled in the account's subscription section; support is available if needed. Disabling it stops future renewals and preserves the remaining paid period. A request to stop using payment details for recurring charges can also be emailed to support@chimate.ai.
7.6. Changing payment providers does not transfer an existing subscription or recurring-payment consent. Existing obligations remain with the original provider. New recurring payments are agreed separately, taking account of active auto-renewal.
7.7. A refund can be requested if no more than 30 credits have been used. Requests are reviewed within up to 3 business days. Email support@chimate.ai with information identifying the payment and a description of the situation.
7.8. The response states the decision and, if a refund is issued, the amount, method and expected settlement time taking account of the payment provider. Reviewing a request and bank settlement are separate stages; the 3-business-day period applies to reviewing the request.
7.9. The refund condition for usage of up to 30 credits does not limit any statutory cancellation right or claims for undelivered or defective services or erroneous charges. Where consumer service-contract rules apply, cancellation refunds take account of substantiated actual expenses to the extent permitted by law; no automatic retention of the entire payment is imposed. The digital nature of the service does not create a blanket ban on refunds. The User retains the right to contact their bank and use lawful remedies.
8. Privacy and data processing
8.1. The Privacy Policy describes the data processed, purposes, recipients, retention periods and procedures for requests. Processing includes account data, submitted images, analysis results, payment information and necessary technical data.
8.2. The Service uses third-party AI providers to fulfil requests. Materials are transmitted and data is processed within the purposes described in the Privacy Policy. Users should review screenshot contents before submitting them.
8.3. This Agreement does not replace separate data-processing consent where required by law. Optional analytics have separate settings. Data requests are sent to support and reviewed with regard to the grounds for processing and retention periods. Closing an account does not immediately delete every record.
9. Changes and disputes
9.1. New versions are published with an updated date. Material changes are communicated on the website or by email. Terms for new orders and renewals are shown before they are placed; any necessary new consent is obtained separately. Updated terms do not retroactively reduce rights for an already paid period.
9.2. Users may contact support@chimate.ai to resolve a disagreement. Include the account email, a description of the situation and, for purchase-related questions, information identifying the payment.
9.3. The parties' relationship is governed by applicable law, including mandatory consumer protection rules. Contacting support does not remove the right to use other remedies or bring proceedings as provided by law.
